We wish to express our strongest consternation in the manner in
which the MMS/Baazee.com case is being handled by Delhi Police. We specially
condemn the arrest and continued detention of Avnish Bajaj, CEO of Baazee.com.
Anyone knowledgable about how Internet works knows that it is nearly impossible for
any site operator to control what its members do. Internet was designed to be
such a medium from its very begining and the implied liability being attributed
by Delhi Police is considered untenable. This is akin to holding the government
responsible when a trader sells adulaterated product in an Anaaz Mandi operated under
aegis of district administration. Or making Microsoft liable for the junk porn that we daily get in our hotmail mailboxes. Next time Bill Gates comes to delhi, some Delhi cop might arrest him. While we recognise the seriousness of the trade made and condemn such activity in the strongest manner possible, at the same time we express our condemnation in the manner this case is being treated.
Regardless of the legal interpretations of Delhi Police and Courts, it is beyond reason as
to what purpose is being served by continued detention of Avnish Bajaj, CEO of
Baazee.com.
Mr Avnish Bajaj is not a criminal who needs to be kept behind bars for fear
of him causing more damage to society. In this environment when the government goes
around pleading all over the world for investments in India, Mr Avnish Bajaj
had brought nearly $25 million (100 crore) to India for Baazee.com and in his
stewardship led the company through risky times to be a successful business. It is such
kind of flawed rule of law that encourages Indian talent to migrate and remain
abroad.
Mr Bajaj could very well have done so but he chose to return and start a
company the success of which has been not only motivating to others but also has
retained some of the talent in the country by offering these youngsters a rewarding
career in India. It is indeed shameful that such a treatment in being meted to
someone like him. Since there is no comprehensible purpose served by continued
detention of Mr Avnish Bajaj, we request that he be immediately released.
